1. Acceptance of Terms

By accessing and using Tribute to Gary ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Tribute to Gary is a memorial website that allows users to share memories, photos, stories, and tributes about Gary Craig. The Service provides a platform for friends, family, and acquaintances to contribute content in remembrance.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must:

  • Create an account by providing accurate and complete information
  • Provide your email address, name, and relationship to Gary
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account

3.2 Google OAuth

You may choose to sign in using Google OAuth. By doing so, you authorize us to access certain information from your Google account as described in our Privacy Policy. Your use of Google OAuth is also subject to Google's Terms of Service, available at https://policies.google.com/terms.

3.3 Account Responsibility

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms of Service.

4. User Content

4.1 Content Submission

By submitting content (tributes, stories, comments, photos) to the Service, you:

  • Grant us a non-exclusive, royalty-free, perpetual license to display, distribute, and modify your content on the Service
  • Represent that you own or have the right to submit the content
  • Agree that your content may be publicly displayed (subject to moderation)
  • Understand that content is subject to review and moderation by administrators

4.2 Content Guidelines

You agree not to submit content that:

  • Is defamatory, abusive, harassing, or offensive
  • Violates any third-party rights, including copyright, trademark, or privacy rights
  • Contains false or misleading information
  • Is spam, advertising, or promotional material
  • Contains viruses or malicious code
  • Violates any applicable laws or regulations

4.3 Content Moderation

We reserve the right to review, edit, reject, or remove any content at our sole discretion. Content must be approved by administrators or moderators before being displayed publicly.

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Tribute to Gary and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you submit, but grant us the license described in Section 4.1.

7. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties.

You may terminate your account at any time by contacting us or using account deletion features (if available).

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Indemnification

You agree to defend, indemnify, and hold harmless Tribute to Gary and its operators from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the Service or violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service operates, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by updating the "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
